SegKind Limited TERMS & CONDITIONS
  1. Restrictions
  2. 1.1 All Segway riders must weigh over 45 kilos (7 stone).

    1.2 All Segway riders must weigh under 117kilos (18.5 stone).

    1.3 Any customers suspected of being under the influence of alcohol will not be permitted to use Segkind’s services and will forfeit their full booking fee.

    1.4 Any customers suspected of being under the influence of non-prescription drugs will not be permitted to use Segkind’s services and will forfeit their full booking fee.

    1.5 Any customers on prescription drugs that may cause drowsiness or alter perception will not be permitted to use Segkind’s services and will forfeit their booking if Segkind is not notified in writing prior to arrival.

    1.6 Pregnant women cannot be permitted to participate for safety reasons.

    1.7 Riders must have the ability to make motions such as climbing and descending stairs without assistance.

    1.8 Persons under the age of 18 years must be accompanied by an adult at all times.

    1.9 No pets or animals are permitted on any site or at any event run by Segkind Limited.

    1.10 No children under 10 years old may take part.

    1.11 Customers MUST inform Segkind staff of any disability, injury or medical problem that may prohibit them taking part in a Segway Rally experience or any other Segway riding activity.

    1.12 Riders must have proficient eye sight and hearing in order to participate in any of Segkind’s Segway activities or events.


  3. Segkind Cancellations
  4. 2.1 Segkind may on occasion be required to cancel Segway events or the SegRally Segway Rally Experience sessions due to adverse weather conditions or from situations outside of the control of Segkind.

    2.2 Segkind may on occasion be required to cancel Segway events or the SegRally Segway Rally Experience sessions due to technical or staff related problems outside of its control.

    2.3 Force Majeure Segkind shall not be deemed to be in breach of any duty, agreement or contract or otherwise be liable to any customers or individuals by reason of any delay or failure in the performance or its obligations under any duty, agreement or contract to the extent that such delay or failure is caused by force majeure of which it has notified customers or individuals and the time for performance of the relevant obligation shall be extended accordingly. Force Majeure shall include acts of God, acts of Government, fires, floods, epidemics, freight embargoes, civil commotion, labour disputes, terrorism or any cause which is reasonably beyond the control of Segkind. If the Force Majeure in question prevails for a continuous period in excess of three months then Segkind shall enter into bona fide discussions with a view to alleviating its effects or to agreeing upon such alternative arrangements as may be fair and reasonable.

    2.4 If Segkind cancels any events or Segway experiences notice will be given as soon as possible (this may occur after the arrival of customers to a SegRally Segway Experience or Segway event). Customers will be contacted using the contact details provided at the time of booking.

    2.5 No compensation or refund for any expenses incurred and/or for the cost of any vouchers or event fees will be made due to any cancellations made by Segkind for any reason whatsoever.

    2.6 Segkind will endeavour to provide the same service as originally booked as soon as possible.

    2.7 Segkind reserves the right to refuse or withdraw its services without any reason or compensation.


  5. Customer Cancellations
  6. 3.1 No refund will be paid on ANY booking cancelled within 28 days of the event date.

    3.2 Bookings cancelled prior to 28 days of the event date incur 50% of the service cost as a cancellation penalty.

    3.3 No refund will be paid on ANY booking where the customer fails to arrive for ANY reason.

    3.4 No refund will be paid on ANY booking where the customer arrives late for ANY reason.

    3.5 Any customer that fails to arrive will not be offered a new date to take part.

    3.6 If a customer cancels their booking within 28 days of the event date and chooses to re-book, a re-booking fee of £7.80 per participant will be charged.

    3.7 In the event of adverse weather conditions, customers will be contacted by Segkind if the SegRally Segway Experience or other Segway event is to be cancelled. No customer is entitled to make a judgement as to whether the SegRally Segway Experience or other Segway event should be cancelled due to adverse weather conditions.


  7. Bookings
  8. 4.1 Any SegRally Segway Experience and/or event can only be provided to customers subject to full payment of the said services. Proof of purchase and/or receipt of vouchers is required for supply of any of Segkind’s services.

    4.2 Customers who have purchased gift vouchers (from certain providers listed in your confirmation email) must make sure that the voucher/s are in Segkind’s possession no later than 5 days before their Rally is due to take place (address details will be provided with confirmation email). If a voucher is due to pass its expiry date customers must make sure that the voucher is in Segkind’s possession before the expiry date marked on the voucher (unless written confirmation of an extension has been issued by a voucher vendor). Vouchers can only be used in conjunction with any deal as agreed with the voucher provider.

    4.3 Customers are advised to send vouchers by recorded post. Segkind will not accept responsibility for any vouchers lost in the post. Segkind will not send confirmation of receipt of vouchers.

    4.4 Bookings are subject to availability.

    4.5 All Bank Holiday dates are considered as weekends and are not available to customers using weekday offer vouchers (unless an upgrade fee is applied).

    4.6 Confirmation for the SegRally Segway Experience will be sent by email. This email is generated automatically; If the email is not received within 2 hours of your booking being placed we will rely on you to let us know. Customers can contact us via email enquiries@segkind.com.

    4.7 Bookings are subject to customers supplying requisite contact details. A valid email address, post code and mobile telephone number must be supplied.

    4.8 Full payment is required at the time of booking for most services.

    4.9 All voucher upgrades must be paid at the point of booking (currently upgrades can only be taken over the phone).


  9. Hire
  10. 5.1 Any individual hiring a Segway is not permitted to sub-contract or re-hire all or part of Segkind’s facilities.

    5.2 Segkind reserves the right to include additional hourly charges of not less than £50.00 + VAT for any late return of Segways hired or for any events which exceed the agreed duration.

    5.3 Losses amounting to the replacement value of any Segway or other machinery hired by fault of the customer will be charged to the said customer.

    5.4 Segways not in use whilst on hire by a customer must be stored in a locked environment with infokey/s removed – You may be charged the full amount of our insurance excess costs and for any loss of business if we need to claim for any loss of our property that you have hired.


  11. General
  12. 6.1 Segkind reserves the right to alter or change these terms and conditions at any time without prior notice.

    6.2 Segkind reserves the right to alter the format of its services without any reason or compensation.


    6.3 Abusive behaviour or language or any threats made to anyone under the employment of Segkind Limited will not be tolerated and will result in a prosecution and any purchase made for any service will be cancelled without a refund.

    6.4 All riders are required to wear helmets and any other safety clothing which has been supplied by Segkind.

    6.5 All riders are required to wear suitable footwear. Any customer wearing high heels, open toed shoes or slippery flat soled shoes will not be permitted to participate (the ideal footwear is light grippy boots or trainers).

    6.6 All riders are required to wear suitable clothing. Any clothing that restricts movement is not permitted.

    6.7 Customers are advised to arrive 15 minutes prior to the start time of their session, customers who arrive late for their session will not be able to participate and will not be entitled to a refund.

    6.8 All customers participating in any of Segkind’s SegRally Segway Experience or Segway events must acknowledge and accept that they are taking part in a potentially dangerous activity that may result in serious injury and/or death.

    6.9 Failure to comply with any of Segkind’s terms and conditions, rules or instructions may affect the ability of any customer to claim on our public liability insurance.

    6.10 All SegRally Segway Rally Experience customers must sign our disclaimer before participation. By signing this disclaimer all customer’s or individuals making use of any of Segkind’s services agree to indemnify Segkind and its directors, officers, employees and third party agents from and against loss, claims, liabilities, damages, expenses, direct, indirect or consequential, incurred by any customer or individual arising from any negligence or wrongful act or omission by the individuals or the customer’s directors, officers, employees, sub-contractors, agents or representatives.

    6.11 These terms and conditions apply to any Segkind customer or approved agents bound by agreement or contract.
